1. Who we are and what these Terms cover
These Terms of Sale and Use (the "Terms") govern your use of the Figurly website, the design tools and previews on it, your account, and every order you place with us. "Figurly", "we", "us" and "our" mean the company that operates the Figurly website, identified with its registered office and registration details in our Legal Notice. "You" means the person using the site or placing an order.
By using the site, you agree to the parts of these Terms that govern use of the site. By ticking the acceptance box at checkout and placing an order, you agree to all of these Terms, in the version published on this page at that moment. We record that acceptance, with its date and version number, against your order.
If you do not agree to these Terms, do not use the site and do not place an order.
Our Privacy Policy, Cookie Policy and Shipping and Returns page form part of these Terms. If one of them contradicts these Terms, these Terms prevail, except where the Privacy Policy gives you more protection over your personal data.
2. Who may order
You must be at least 18 years old, or the age of legal majority where you live if that is higher, and able to enter into a binding contract, to create an account or place an order. A minor may use the site only under the supervision of a parent or legal guardian, who accepts these Terms on the minor's behalf and is responsible for their use of the site.
Our figurines are sold to consumers for personal use or as gifts. Orders placed by a business, orders for resale and bulk orders require our prior written agreement. If you order in the course of a business, the protections these Terms give only to consumers do not apply to you.
3. Your account
You must give accurate and complete information, keep it up to date, and keep the sign-in codes we send you confidential. You are responsible for everything done through your account and your email address. Tell us at once at hello@figurly.co if you believe someone else has used them.
We may suspend or close an account, refuse service, or cancel orders that have not entered production, at any time and without prior notice, where we reasonably believe that you have breached these Terms, acted fraudulently, abused the free previews or a promotion, or exposed us or others to legal risk. When we cancel a paid order for one of these reasons before production, we refund what you paid for it, and that refund is our only obligation.
4. Design tools and free previews
Before you pay, the site lets you upload photos and see preview images and 3D views of a possible figurine. Previews are offered free of charge, within limits we set, to help you decide. They are illustrations, not an offer to sell a particular result, and they are not part of any contract.
Previews and renders are produced with digital design tools, some of them operated by third-party service providers. Results vary from one attempt to the next, and we do not guarantee that a preview will be available, accurate, error-free or to your liking.
Access to previews is limited per visitor, per device, per network and per day, and we may change, reduce or withdraw those limits at any time. Any preview allowance, token or credit shown on the site has no cash value, cannot be bought, sold, transferred or refunded, and ends when we withdraw it or when your account is closed.
You must not get around those limits: no multiple accounts, no clearing of cookies or switching of devices or networks to obtain more previews, no scripts or bots, and no attempt to extract, copy or reuse our instructions, settings, files or outputs outside the site.
Previews remain our property. You may keep them for your own personal, non-commercial use, for example to decide on an order or to show it to family. You may not sell them, use them commercially, or use them to have a figurine made by anyone else.
5. Your photos and instructions
When you upload a photo or write an instruction, you confirm that: (a) you took the photo yourself, or you hold every right and permission needed to use it for this purpose; (b) every person who can be recognised in it has agreed to a figurine being made of them, and where that person is a minor, you are their parent or legal guardian or act with that person's consent; (c) it does not infringe anyone's copyright, trademark, image rights, privacy or any other right; and (d) it complies with the rules in "What we will not make" below.
You keep every right you hold in your photos. You grant Figurly a worldwide, non-exclusive, royalty-free licence to store, copy, process, adapt and transmit your photos and instructions, including to our service providers and manufacturing partners, solely to produce previews, make and deliver your order, answer your support requests, prevent fraud and abuse, and comply with the law. The licence ends when the photos are deleted under our Privacy Policy, except for copies we must keep by law or to establish or defend a legal claim.
We do not sell your photos, we do not use them in our advertising without your separate written consent, and we do not use them to train any model.
6. What we will not make
We may decline, at our sole discretion, any content or order that in our judgment: shows a person who has not agreed to it; shows a minor in any inappropriate way; contains nudity, sexual content, violence or hate symbols; is unlawful, defamatory, harassing or offensive; reproduces a character, costume, logo, trademark or other element protected by someone else's rights (from a film, game, comic, sports team or brand, for example); imitates a public figure or could be used to mislead; or could expose Figurly or its partners to legal or reputational harm.
If we decline an order after you have paid, we refund it in full, and that refund is our only obligation. We may also delete the content concerned, suspend the account, and report unlawful content to the competent authorities.
We are not obliged to review content before it is processed, and accepting an order does not mean that we have checked or approved the rights in it. Those remain your responsibility.
7. The figurines
Each figurine is a stylized interpretation of the photos you send, in the rendering, universe, format and size you chose. It is not a portrait or a photographic reproduction, and we do not promise a likeness beyond what the render you approve shows. The render you approve is the reference for your order.
Figurines are made by 3D printing and then finished. The following are normal characteristics of the product, not defects: fine layer lines or surface texture; differences in colour, shade or finish between the render on your screen and the physical piece, because every screen displays colour differently; a variation of up to 5% from the stated dimensions; and small differences in fine details such as strands of hair, small accessories or lettering.
A figurine is a decorative collectible, not a toy. It has small and fragile parts and is not suitable for children under 14. Keep it away from young children and pets, from heat sources, from prolonged direct sunlight and from water. We are not responsible for damage caused by a fall, misuse, alteration or improper care.
Photos, sample figurines and illustrations on the site show examples. Your figurine will differ from them.
8. Prices and payment
Prices are shown in the currency of the market you are browsing. The price, the delivery cost and any taxes are shown at checkout before you pay, and the total shown there is the amount you pay. Unless the checkout says otherwise, prices include the taxes that apply in that market.
We may change our prices, offers and products at any time. A change never affects an order that has already been paid.
If a price is obviously wrong because of a technical or typing error, we are not bound by it. We will tell you, and you can either confirm the order at the correct price or cancel it and receive a full refund.
The full amount is charged when you place your order, through our payment provider. We never see or store your full card number. You confirm that you are entitled to use the payment method you provide. Any fee charged by your own bank or card issuer, including for currency conversion, is yours to pay.
A promotional code is valid only on the conditions stated with it and, unless stated otherwise, once per order and never in combination with another offer. It has no cash value. We may cancel a code, or the discount it gave, if it was obtained or used fraudulently or against its conditions.
9. How an order becomes a contract
Placing an order is an offer to buy. The contract is formed when we send you the order confirmation email. We may refuse an order before that point. In exceptional cases we may also cancel it afterwards: content we decline, suspected fraud, an obvious price error, or a figurine we are unable to make. In each of those cases we refund in full everything you paid for the order, and we have no further obligation to you.
Check your order carefully before you pay: the format, size and options, the spelling of any text, and the delivery address. We make what you ordered and approved.
10. The render, revisions and approval
After payment, we prepare a 3D render of your figurine and send it to you for approval. Nothing is printed before approval.
2 revision rounds are included. A revision is a request to change the render within the order you placed, for example the pose, the outfit or an accessory. A change of format, size, number of people or universe is a new order, not a revision. Further rounds beyond those included are at our discretion and may be charged.
If we don't hear from you within 24 hours of sending the render, production starts on the version we proposed. In that case the render counts as approved, with the same effect as your express approval. The email that sends you the render states the deadline and what happens when it passes. It is up to you to give us a working email address and to check your inbox, including your spam folder.
Once the render is approved, expressly or because the deadline has passed, it becomes the final specification of your order. Production starts, and the order can no longer be changed or cancelled.
Until then, you can cancel your order at any time by writing to hello@figurly.co, and we refund you in full within 14 days, to the payment method you used. If you cancel, the render and every file prepared for your order remain ours, and you receive no right to use them.
11. Personalised figurines: no change-of-mind returns or exchanges
Each figurine is made specifically for you from your photos, your instructions and your selected configuration. It is a clearly personalised product, not a stock item. We do not offer change-of-mind returns or exchanges of personalised figurines after approval of the render, including after delivery.
For consumers in France, the 14-day right of withdrawal is excluded by Article L221-28, 3° of the French Consumer Code. For consumers elsewhere in the European Union, the corresponding exception is Article 16(c) of Directive 2011/83/EU, as implemented in national law. This exception applies to goods made to the consumer's specifications or clearly personalised, whether or not production has already begun. Outside those markets, this exclusion applies only to the extent permitted by the mandatory law applicable to your purchase.
Separately from that statutory exception, we voluntarily offer a full refund if you cancel before the render is approved, under "The render, revisions and approval". This contractual cancellation promise remains available even though personalised goods are excluded from the statutory cooling-off right. Once the render is approved under that process, this voluntary cancellation option ends and production can start.
After approval, a change of mind, a gift recipient's preferences, a later wish to change the pose, style, size or inscription, or an error in the instructions you supplied and then approved does not entitle you to a return, exchange or refund when we have correctly fulfilled the agreed specifications. Check the render and every personalised detail before approval. This does not excuse an error made by us or a product that does not conform to the contract.
Contact us at hello@figurly.co with your order number before sending anything back so we can provide the appropriate return instructions. Sending back a conforming personalised figurine does not, by itself, create a right to a refund. This instruction does not make any statutory remedy conditional on our discretionary approval.
These exclusions concern change-of-mind returns only. They do not limit your rights for a damaged, defective, incorrect or non-conforming item, non-delivery, or any other mandatory legal remedy. The legal guarantee of conformity and, where applicable, the warranty against hidden defects remain in force. See "Damage, defects and our reprint promise". Your checkout acknowledgement confirms that you were informed of the personalised nature of the order; it does not waive these rights.
If we sell a non-personalised item separately, the personalised-goods exception does not apply to that item. Where the applicable law provides a 14-day withdrawal right, notify us at hello@figurly.co within 14 days of delivery and return it within 14 days of that notification. Direct return costs are yours only if disclosed before purchase. We refund the sums required by law, including standard outbound delivery costs where applicable, within 14 days of your withdrawal notice; for goods, we may withhold the refund until receipt of the item or proof of its return, whichever comes first. Original packaging is not a condition of withdrawal. You may be responsible for diminished value caused by handling beyond what is necessary to establish the item's nature, characteristics and functioning, where the law allows it.
12. Production and delivery
Production takes about 10 business days after approval (4 business days with the express option), followed by transit, usually 3 to 5 business days to most destinations. These are estimates, not guaranteed dates, and they run from approval, not from payment. We are not responsible for delays caused by a late approval, an incorrect address, customs, carriers, or events beyond our control.
We are not liable if a figurine arrives after a particular occasion such as a birthday, a wedding or a holiday, unless we expressly agreed a firm delivery date with you in writing. If you need it by a date, order early and choose the express option.
If we have not delivered within 30 days after the estimated date, you may ask us to deliver within an additional reasonable period. If we still do not deliver within that period, you may cancel the order and receive a full refund. That is your remedy for late delivery, except where the law of your country gives you more.
You must give a complete and correct delivery address. We are not responsible for a parcel delivered to the address you gave, nor for a parcel lost or returned because that address was wrong or incomplete; sending it again is at your cost. Risk of loss or damage passes to you when the parcel is delivered to that address or to a person or place you designated. Ownership of the figurine passes to you on delivery, provided the order has been paid in full.
A parcel sent across a border may be subject to import duties, taxes and customs fees. Unless the checkout states that they are included, you are the importer and you pay them. A personalised item refused or abandoned at customs is not refunded; we can send it again at your cost.
13. Damage, defects and our reprint promise
If your figurine arrives broken, or clearly different from the render you approved (beyond the normal characteristics described in "The figurines"), we reprint it free of charge. To use this promise, write to hello@figurly.co within 14 days of delivery, with your order number and clear photos of the figurine and its packaging. We may ask you to keep the parcel and packaging for the carrier to inspect, or to send the figurine back at our cost. A reprint is made from the same approved render.
If a reprint is not possible, we refund the price of the figurine concerned.
This reprint promise comes in addition to your statutory rights. Its 14-day reporting period does not shorten the time limits for a statutory claim. Personalisation does not remove the legal guarantee of conformity or, where applicable, the warranty against hidden defects. Depending on the applicable law and the circumstances, you may be entitled to repair, replacement, a price reduction or a refund. Nothing in these Terms makes a free reprint your exclusive remedy or limits any consumer right that cannot be excluded by contract.
14. Payment disputes
If something is wrong with your order, write to us first at hello@figurly.co: it is almost always faster than going through your bank. If you dispute a payment with your bank for an order whose render was approved, or for a figurine that was delivered, we will contest the dispute and give your bank the evidence we hold, including your acceptance of these Terms, the approval of the render and the delivery record. We may close the account of a customer who files a dispute that proves unfounded and refuse their future orders.
15. Our intellectual property
The site and everything on it (text, design, images, sample figurines, software), and the 3D models, renders, print files and other files we prepare for your order, belong to Figurly or its licensors and are protected by intellectual property law. Your order makes you the owner of the physical figurine, not of those files or of any right in them. We do not supply 3D model or print files.
We will not use a model or render showing you, or anyone in your photos, for any purpose other than your order (including a reprint and support), unless you give us separate consent.
You may not copy, scrape, reproduce, frame, sell or otherwise exploit any part of the site, or use the Figurly name or logo, without our prior written consent.
16. Using the site
You must use the site lawfully and in line with these Terms. In particular, you must not: access or collect data from the site with bots, scrapers or other automated means (other than public search engines within the limits we set); copy, decompile or reverse-engineer any part of the site or its tools; test, probe or circumvent its security, its limits or its content rules; upload malicious code or overload the service; impersonate anyone; or place fraudulent orders or file fraudulent payment disputes.
We may monitor use of the site to protect its security and prevent abuse, and we may block access from any account, device or network involved in a breach of these Terms.
17. Reviews and feedback
If you send us a review, a photo of your figurine or other feedback, you confirm that it is honest, based on your own experience and lawful. You grant Figurly a worldwide, non-exclusive, royalty-free licence to publish, reproduce, translate and display it on the site and in our communications, with your first name and country. We may moderate, decline or remove reviews. We do not publish a photo showing a person's face without that person's consent. You can ask us at any time to remove a review you wrote.
We may use any suggestion or idea you send us freely, without any obligation to you.
18. Availability of the site
THE SITE, THE PREVIEWS AND THE DESIGN TOOLS ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE EXTENT PERMITTED BY LAW, WE GIVE NO WARRANTY, EXPRESS OR IMPLIED, THAT THEY WILL BE UNINTERRUPTED, SECURE, ERROR-FREE OR FIT FOR A PARTICULAR PURPOSE, AND WE MAY CHANGE, SUSPEND OR WITHDRAW ANY PART OF THEM AT ANY TIME.
This clause concerns the site and the previews only. A figurine you buy carries the promises in "Damage, defects and our reprint promise" and every right that the law gives you.
19. Our liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for any other liability that cannot be excluded or limited under the law that applies to you. If you are a consumer, nothing in these Terms affects your mandatory statutory rights.
SUBJECT TO THE PARAGRAPH ABOVE, AND TO THE EXTENT PERMITTED BY LAW: (A) WE ARE NOT LIABLE FOR ANY LOSS THAT WAS NOT REASONABLY FORESEEABLE WHEN THE CONTRACT WAS MADE, NOR FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL LOSS, INCLUDING A MISSED OCCASION, DISAPPOINTMENT, LOSS OF DATA, LOSS OF PROFIT OR LOSS OF OPPORTUNITY; (B) WE ARE NOT LIABLE FOR ANY DELAY OR FAILURE CAUSED BY EVENTS BEYOND OUR REASONABLE CONTROL; AND (C) OUR TOTAL LIABILITY FOR ANY ORDER IS LIMITED TO THE PRICE YOU PAID FOR THAT ORDER, AND OUR TOTAL LIABILITY IN CONNECTION WITH THE USE OF THE SITE WITHOUT AN ORDER IS LIMITED TO 100 US DOLLARS OR 100 EUROS, DEPENDING ON THE CURRENCY OF THE MARKET YOU BROWSE.
If you use the site or order in the course of a business, we are not liable to you for any loss of profit, revenue, business or opportunity, whatever its cause.
20. Your responsibility towards us
To the extent permitted by law, you will compensate Figurly, its officers, employees and partners for any loss, liability, claim or cost (including reasonable legal fees) arising from your breach of these Terms, from the photos and instructions you send, or from your infringement of the rights of anyone else.
21. Events beyond our control
We are not responsible for any delay or failure caused by events beyond our reasonable control, including natural disasters, epidemics, war, terrorism, strikes, failures of carriers, customs or suppliers, outages of third-party services, power or internet failures, cyberattacks and government action. We will let you know, and our obligations are suspended for as long as the event lasts. If it delays an order by more than 60 days, either of us may cancel the order, and you are refunded for anything not delivered.
22. Changes to these Terms
We may update these Terms at any time. An order is governed by the version you accepted at checkout, identified by the version number at the top of this page, and later changes do not apply to it unless the law requires. For the use of the site, a change applies from the moment it is published here, and continuing to use the site means you accept it. We announce material changes on the site.
23. Governing law and disputes
Before starting any claim, write to us at hello@figurly.co and give us 30 days to resolve it. Most issues are settled that way.
These Terms, and any dispute arising from them or from an order, are governed by the law of the country where the company operating Figurly has its registered office, as stated in our Legal Notice, excluding its conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods. If you live in the United States, they are governed instead by the Federal Arbitration Act and, for everything else, by the law of the State of Delaware, excluding its conflict-of-laws rules. If you are a consumer, neither choice deprives you of the protection of the mandatory rules of the law of the country where you live.
If you are a consumer living in the European Union, the United Kingdom, Switzerland or Norway, you may bring proceedings in the courts of the country where you live, and you may also refer a dispute to a consumer mediation or alternative dispute resolution body. We will tell you on request which body is competent. Outside those cases, and subject to the section below for customers in the United States, the courts of the place of our registered office have exclusive jurisdiction.
24. Binding arbitration and class action waiver (United States only)
THIS SECTION APPLIES ONLY IF YOU LIVE IN THE UNITED STATES. PLEASE READ IT CAREFULLY: IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO GO TO COURT.
You and Figurly agree that any dispute, claim or controversy arising out of or relating to these Terms, the site or any order (a "Dispute") will be resolved by binding individual arbitration and not in court. Either party may instead bring an individual claim in small claims court if it qualifies, and either party may ask a court for an injunction against the infringement of its intellectual property rights.
The arbitration is administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules in force at the time, before a single arbitrator. It may take place by video, by telephone, on written submissions, or in person in the county where you live. Filing, administration and arbitrator fees are allocated as those rules provide. The arbitrator decides every question, including the scope and enforceability of this section, except the enforceability of the class action waiver below, which a court decides.
YOU AND Figurly MAY EACH BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. YOU AND Figurly EACH WAIVE ANY RIGHT TO A JURY TRIAL. If this waiver is found unenforceable for a particular claim, that claim must be severed and decided by a court, and this section continues to apply to every other claim.
You may opt out of this section within 30 days of first accepting these Terms, by writing to hello@figurly.co with your name, your order number if you have one, and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.
25. General
These Terms, together with the documents they refer to and your order confirmation, are the entire agreement between you and Figurly about their subject. If a court finds any provision invalid or unenforceable, that provision is limited or removed to the minimum extent necessary, and the rest of these Terms remains in force. Our failure or delay in enforcing a provision is not a waiver of it.
We may transfer our rights and obligations under these Terms to another company, provided this does not reduce your rights. You may not transfer yours without our written consent. No one other than you and Figurly has any right to enforce these Terms.
You agree to receive contractual information, confirmations and notices by email and on the site, and that these satisfy any legal requirement for written communication.
These Terms are written in English. Where we provide a translation, it is for convenience, and the English version prevails if the two differ, to the extent permitted by the law that applies to you.
Every clause that by its nature should survive the end of these Terms or of an order survives it, in particular those on intellectual property, liability, your responsibility towards us, and governing law and disputes.
